$5,000,000 Rear-End Car Accident in Tampa (2024)

Our client, who is a medical doctor, came to a complete stop at a green traffic light for an ambulance who was responding to an emergency. The Defendant driver failed to stop, causing a high-speed collision with the back of our client’s car, propelling it into the intersection. Both vehicles suffered extensive property damage, with our client’s car being completely totaled.

The client was taken from the scene to a nearby emergency room by ambulance, where he reported experiencing neck pain that extended to his arms. He had no previous history of significant neck pain. Following treatment at the hospital, he underwent a series of physical therapy sessions. An MRI of his neck revealed several large, herniated discs. After conservative treatment failed to relieve his pain, he opted for a lengthy and complex two-part surgery, during which his surgeon operated on both the front and back of his neck and fused four levels of his cervical spine. Regrettably, he experienced a spinal cord leak during the surgery and had to undergo emergency surgery days later. Following the second surgery, he suffered from intense, debilitating pain due to nerve damage, and his left arm was severely affected. Physicians diagnosed him with Complex Regional Pain Syndrome (“CRPS”) and administered numerous stellate ganglion nerve block injections and ketamine infusions. Unfortunately, none of the treatments attempted by the doctors were successful in alleviating his debilitating pain.

Our firm took proactive measures by initiating a lawsuit early and conducting thorough discovery. We conducted depositions of the defendant driver and other witnesses. Furthermore, our firm enlisted the expertise of multiple expert witnesses, such as a life care planner/physiatrist to assess our client’s future medical needs, an economist to calculate the cost of our client’s future care, and an accident reconstructionist to help establish the defendant’s liability for the accident. Additionally, we consulted pain management/CRPS specialists, a radiologist, and a spine surgeon to inform the jury about the nature and severity of our client’s injuries. The defendants also hired their own experts, including a spine surgeon, to challenge the cost of our client’s medical treatment and the necessity of future medical care. They even hired their own accident reconstructionist to argue that our client could have safely proceeded through the intersection without stopping for the ambulance.

Once the case was scheduled for trial, the defense presented their initial offer of $1,500,000.00. This offer was promptly declined as it did not adequately compensate our client for the significant losses suffered. Subsequently, the defense made multiple additional offers, culminating in a proposal to resolve the case for $3,100,000.00. Despite these efforts, all offers were turned down, and we maintained our stance that our client deserved fair compensation. Throughout this period, depositions of expert witnesses were conducted by both parties. Notably, during the deposition of the defendant’s expert spine surgeon, it was established that the accident necessitated surgery and led to lifelong damages due to post-surgical complications. As the trial date drew near, the defense acknowledged the substantial liability they faced. They submitted two settlement proposals of $4.0 million and $4.25 million, both of which were rejected.

Ultimately, after further negotiations, we aggressively pushed the defense attorneys to compensate our client $5,000,000.00, leading to the resolution of the case. In total, we persuaded the insurance company attorneys to pay our client a fair amount of compensation for their injuries. The settlement amount that we obtained exceeded the defense’s initial payment proposal by $3,500,000.00.
