Here’s Why You Should Have an Experienced Florida Auto Accident Lawyer Represent You

Progressive Insurance airs a lot of television commercials. Their gimmick is to have the familiar “Flo” pitch ways to save on auto and home insurance, along with other insurance products.

Based on Progressive’s aggressive ad campaign, you might think that they are easy to deal with if you file a claim for personal injury compensation. However, Progressive Insurance settlement offers, like other major insurance company offers, are notoriously low.

Abrahamson & Uiterwyk are the Florida auto accident attorneys you need to help you get a fair settlement from Progressive. Drawing upon our 30 years of experience fighting for accident victims in Florida, we assemble the best compelling case possible. We advocate for you and help you pursue the compensation you deserve.

Progressive Settlement Payout in Florida

How much compensation you get for a Progressive bodily injury settlement in Florida varies based on the unique circumstances of each situation and the severity of your injuries. Based on our own settlement data on this page, the average Progressive settlement payout is between $110,000 to $350,000.

Progressive Insurance is a massive insurance company that is in business to make money. As a result, Progressive does not pay out easily. Instead, Progressive Insurance will nitpick every part of your claim to find ways to reduce your Progressive Insurance settlement offer.

They will blame you for causing the accident or try to show that your injuries are not as serious as you say they are. Also, Progressive’s representatives may try to offer less than you want because you had a prior accident claim or previous injury.

$350,000 Progressive Settlement Payout for Car Accident

In this tragic accident, our client was a passenger in a vehicle being operated by a medical transport company driver. As the driver prepared to change lanes on U.S. 441 in Palm Beach County, FL, she suddenly lost control of the car as a result of overcorrecting as the vehicle pulled to the left. Skidding across the roadway, the vehicle rolled over onto its roof and ultimately collided with a guardrail.

Our client had to be airlifted to the nearest trauma center in West Palm Beach. He was suffering from pain in his neck, left shoulder, lower back, right side, and abdomen. Imaging studies showed that he had sustained a herniated disc in his neck and multiple bulging discs in his neck and back. Our client followed up with his orthopedic surgeon for pain in his back, right knee, and left shoulder. Later testing revealed that he had suffered a serious shoulder separation injury. His right knee, which had been operated on only a few days before the crash and for which he was being transported to the doctor at the time of the crash, was also reinjured and he underwent physical therapy for it.

The driver of the transport vehicle had only $50,000.00 in insurance coverage, and, given the significance of the injuries involved, her company quickly paid those limits to our client. We then discovered that the driver’s employer had an additional liability policy with a limit of $300,000.00. We prepared a detailed and comprehensive settlement package for the insurance company and demanded that they pay the full limit of their coverage. Recognizing their substantial liability, the company was convinced to tender its $300,000.00 to our client.

Following the payments by the insurance companies, we also worked hard to reduce the health insurance and worker’s compensation liens that our client was obligated to pay from his settlement. We were ultimately able to cut those liens substantially and save our client additional money. He was very happy with the outcome and with our representation.

$290,000 Progressive Settlement Payout for Auto Accident

Our client was on his moped delivering food when he stopped for traffic ahead of him at a cross-walk. The vehicle behind him failed to pay attention to traffic ahead of him and hit the rear of the client’s moped with the front of the vehicle he was driving. Our client sustained a severe left femur fracture requiring an open reduction and internal fixation. Prior to litigation an offer of $165,000 was made which was promptly rejected. The case was transferred to litigation. After several months of litigation an offer of $200,000 was made at the mediation settlement conference. That offer was rejected. After several more months and weeks before trial, the offer was increased and settled for $290,000.

$110,000 Progressive Bodily Injury Settlement for Motorcycle Accident

In this unfortunate accident, our client was headed northbound in the left lane on U.S. 19 in Homosassa, Florida on his motorcycle. The defendant, also riding a motorcycle, pulled out of a business on the east side of the road directly into the path of our client. Our client was forced to brake hard to avoid an impact which caused him to lose control of his bike, and it overturned onto its right side. Witnesses on scene supported the fact that the defendant was wholly responsible for causing the accident.

Our client was taken to the hospital when X-rays revealed a bimalleolar fracture of his right ankle. A bimalleolar fracture involves the breaking of the ends of the two bones of the lower leg, the tibia and the fibula. The fracture required a surgical procedure known as an open reduction and internal fixation approximately two weeks after the accident. The surgery was a success, and our client made a good recovery.

After providing a detailed demand package to the insurance companies involved, we negotiated hard with them in an effort to obtain the compensation our client deserved. After rejecting several offers as insufficient to properly compensate our client for his damages, we were finally able to reach an agreement to settle the claim for $110,000.00. This allowed our client to conclude the case without the prolonged time, expense, and uncertainty of formal litigation. He was pleased with the result, and we were happy we could help him obtain much-needed compensation.

What Factors Affect Progressive Insurance Settlement Offers?

Settlement amounts vary based on many factors. Those factors include:

  • How the accident happened;
  • The amount of medical bills you have;
  • The wages you lost because of the crash;
  • Whether your injuries are permanent;
  • If you have scarring;
  • How long it took for your injuries to heal;
  • Whether you will need medical care in the future;
  • The amount of pain and suffering you endured from the injuries sustained in the crash;
  • Whether you had any emotional trauma such as loss of enjoyment of life; and
  • The amount of damage to your property.

Not every personal injury claim will involve all of these factors. Since no two people are alike, no two claims are alike. It is important to remember that the unique facts of your case determine the settlement offer you receive from Progressive Insurance.

Florida law also factors into your settlement offer. Progressive can lower your offer if you did something to contribute to the accident. This is called comparative negligence.

Under this system, your award is reduced by the same percentage. In other words, your award can be reduced by the amount you were found to be responsible for in the accident.

As we said, Progressive will try to use Florida’s comparative negligence law to its benefit. That is one of the reasons why it is so important to have a highly experienced and knowledgeable Florida car accident attorney represent you.

How Fast Can I Get My Money?

Quick settlements are a trick Progressive Insurance may use from time to time to limit their exposure to paying out a large settlement.

A Progressive representative may try to convince you that a quick settlement is in your best interest. However, before you accept any offer from Progressive, you need to talk to a lawyer first.

Accepting a quick settlement without talking to an experienced car accident lawyer can be extremely risky. A Progressive settlement claim adjuster will not offer you a settlement unless you sign a release.

That release means once you cash your Progressive bodily injury settlement check, you forever forfeit your right to seek additional damages. Even if you need additional surgeries or other medical attention related to the accident, you cannot go after the person insured by Progressive.

Why Should I Get an Attorney to Help with My Progressive Settlement Payout?

You need an attorney to advise you about the Progressive Insurance car accident settlement process.

You might think you could save yourself money by handling your claim by yourself. However, you are far more likely to receive a small settlement if you do not have an attorney.

Additionally, an experienced attorney near you will know where to look for evidence that can strengthen your claim.

Would you know what to do to preserve evidence that is helpful to you? Do you know how to find witnesses and interview them? Would you know how to respond effectively if Progressive denies your claim

Having the right attorney allows you to focus on your recovery and getting your life back on track. An aggressive attorney will take the stress of your claim off your shoulders and personally take on that burden.

If you get a low Progressive Insurance pain and suffering offer, you might end up suing the Progressive insured person who caused your accident.
