no-win-no-fee-contingency-fees-injury-lawyers-florida-au-no fee unless you win lawyers near meHere at Abrahamson & Uiterwyk Car Accident & Injury Lawyers of Florida, we believe that the cost of a lawyer should not be the thing that holds you back from being able to seek compensation after you’ve been the victim of an injury due to the negligence of someone else.

There are a number of expenses that may occur after an accident. Some of these include:

  • Medical Bills
  • Medical Equipment (crutches, wheelchairs, etc.)
  • Property Replacement
  • Rental Car Expenses
  • Loss of Wages
  • Hotel Costs for Out of Town Medical Treatments

These can quickly add up and create an extra burden on top of trying to recover and put the accident behind you. Lawyer fees shouldn’t be part of this list, which is why at our Florida personal injury law firm, we only get paid if you win.

Some Reasons Why We Believe We Are the Right Choice:

We Are a Law Firm With a Reputation for Excellence

That excellence has been recognized by U.S. News and World Report with a “Best Law Firm” rating, the Better Business Bureau as an accredited member, and Martindale-Hubbell receiving an “AV” Rating, which is the highest possible rating based on a national law firm rating system. We’re lawyers that don’t get paid unless you win.

We’ll Fight the Insurance Company to Give You the Best Chance at Fair Compensation

Insurance coverage in motor vehicle cases is incredibly complex. It’s not uncommon for clients to be unaware of their insurance coverage. Likewise, it is not uncommon for insurance adjusters to not fully explain the different types of coverage available to injured victims. Our experience has been that we regularly obtain significantly more compensation for our clients than was initially offered by the insurance company. We’re no win no fee personal injury lawyers in Florida.

What is a No Fee Promise?

At Abrahamson & Uiterwyk, we are honored to represent thousands of clients who have been injured in car accidentsslip & fall accidents, or other accidents due to negligence. As part of this representation, we are proud to offer all of our clients a No Fee Promise or “no win no fee”. This means that you pay no fees or costs unless you receive compensation.

Our No Fee Promise means that if you decide to hire us to represent you in your injury claim, you pay Abrahamson & Uiterwyk nothing upfront. Our Florida law firm uses a contingency fee arrangement to pay for the cost of our legal services. The definition of ‘no win no fee’ means the lawyer only gets paid if the client wins the case or receives a settlement; if there’s no compensation, there’s no fee. We don’t collect any fees or costs unless you win. If you don’t receive compensation, then you owe us nothing. If compensation is obtained, either through a settlement or a verdict at trial, you pay us a percentage of the settlement or verdict.

What Are Contingency Fees & How Do They Work?

You may have heard that personal injury lawyers will take cases on a contingency fee basis. But what does that mean? A contingency legal fee is the amount a lawyer receives when a case is successfully settled or won after trial. When you’ve been injured due to someone’s negligence, you need an experienced attorney near you on your side. Contingency fee agreements allow everyone access to the justice system even if they can’t afford to pay for a lawyer.

Contingency fee arrangements can seem too good to be true, but in these cases, the lawyer takes on any risk that a case may not be successful and pays all case-related expenses upfront. Upon a successful resolution of a case, clients reimburse the lawyer for these expenses. Case-related expenses may include filing fees, deposition expenses, and costs paid to expert witnesses.

Here is an example: a lawyer wins a settlement of $100,000 in a motorcycle accident case where the Florida contingency fee agreement calls for a 33-1/3% fee to the lawyer, the lawyer would receive $33,333.33. If the lawyer had incurred $2,000 in case-related expenses during the course of the case, that amount would be subtracted from the remaining settlement to the client. If the case is not successful, however, the lawyer is out that $2000 of expenses and the hours he or she put into the case while the client isn’t responsible for paying anything.

Here’s How Much I Will Have to Pay My Lawyer in Contingency Fees

The amount of an experienced lawyer’s contingency fee will depend on a number of different factors. Most legal contingency fees in Florida are 33-1/3% if the case settles before a lawsuit is filed, and 40% if a lawsuit is filed. The amount may also depend on the case’s complexity, the nature of the injuries, and the client’s needs.

Florida contingency fee agreements from your lawyer should always be in writing and should specifically spell out the amount of the contingency, which expenses may be deducted from the recovery, and when the expenses will be deducted. There are no hidden costs at our law firm so that you can have peace of mind.

What to Know About Contingent Lawyer Fees and Contingent Costs in a Personal Injury Case

When pursuing a personal injury case, many people worry about the cost of hiring an attorney. Fortunately, personal injury lawyers often work on a contingency basis, meaning they don’t get paid unless you win your case. Understanding what a contingent fee means and how it differs from other costs in a case can help you feel more confident about hiring a contingency lawyer.

What Is a Contingent Fee?

A contingent fee arrangement means that your attorney’s payment is directly tied to the outcome of your case. Under this arrangement:

  • No Upfront Fees: You don’t pay anything upfront. The attorney only gets paid if they successfully recover compensation for you, either through a settlement or court verdict.
  • Percentage-Based Fee: If you win, your attorney receives a percentage of the compensation awarded. This percentage is typically agreed upon at the start of the case, ensuring transparency.
  • Risk-Free Representation: Since there’s no fee unless you win, a contingent fee arrangement can help make quality legal representation accessible to those who might otherwise not afford it.

Contingent Costs: Additional Expenses Beyond Attorney Fees

In addition to attorney fees, a personal injury case may require payment of other expenses, known as contingent costs. These costs are usually necessary to gather evidence, build a strong case, and cover administrative needs. Common contingent costs may include:

  • Court Filing Fees: The cost of filing legal paperwork with the court.
  • Expert Witness Fees: If your case requires expert testimony, such as medical professionals or accident reconstruction specialists, their fees may be included as part of the case costs.
  • Investigation Fees: Costs associated with investigating your accident, including gathering police reports, reviewing medical records, and collecting photographic evidence.
  • Deposition and Document Fees: The costs for preparing and obtaining depositions, transcripts, or additional documentation.

Am I Responsible for Costs if There Is No Recovery?

While many law firms hold clients responsible for costs if the case doesn’t result in a recovery, Abrahamson & Uiterwyk is unique in that we make our costs contingent. This means that if there’s no recovery, you won’t owe attorneys’ fees—and you won’t be responsible for any case costs either. Our no-recovery, no-cost approach provides additional peace of mind, allowing you to focus on your case without financial worry.

How Are Contingent Costs Handled?

Many contingency lawyers, including Abrahamson & Uiterwyk, agree to front these costs on behalf of their clients, so you don’t need to pay them upfront. Typically, these costs are then subtracted from the final settlement or verdict if you win. Discussing these details with your attorney upfront will help clarify expectations and keep you informed throughout the process.

Benefits of Working with a Contingency Basis Lawyer

Choosing a lawyer who works on a contingency basis offers significant benefits, especially if you’re recovering from an injury:

  • Financial Accessibility: A contingency fee structure allows you to hire a skilled attorney without paying out of pocket.
  • Incentive for Success: Contingency-based lawyers are motivated to secure the best possible outcome since their payment depends on it.

Transparent Terms: Reputable contingency lawyers clearly outline their fee structure and costs at the beginning of your case, so you know what to expect if you win.

What Are the Advantages of a Contingency Fee Arrangement?

Contingency fee arrangements with a No Fee/Cost promise provide a number of advantages.

  • Not having to pay money upfront means that you don’t have to worry about paying thousands of dollars to an attorney in order to pursue your claim. And you can focus on your recovery.
  • When a lawyer takes a case on a contingency basis (a.k.a. is a contingency lawyer), the interests of the lawyer and the client are closely aligned. As a result, a lawyer will work hard for his or her client to resolve the case quickly and for the most money possible.
  • A contingency fee arrangement gives the injured person a fighting chance against insurance companies to seek the compensation they deserve.

Case Settlement Example of Compensation for Injured Victims

We are proud of our case results and proud of the jury verdicts that we have obtained at trial. Getting our clients fair compensation for their injuries is our primary focus.

$250,000/Auto Accident/Pinellas County/2023

Our client was disabled from a back surgery she had approximately three weeks before the motor vehicle accident that brought her to our firm. She was a passenger traveling on Carillon Parkway in Pinellas County, Florida with her husband driving when they came to a stop and waited to turn right onto Roosevelt Blvd. Unfortunately, the defendant, who was traveling behind our client, negligently failed to stop and struck our client’s vehicle in the rear.

Our client immediately realized that she had re-injured her back and was also experiencing pain in her neck. She went to the emergency room for treatment. In follow-up with an orthopedic surgeon, it was determined that she had further aggravated her back condition. Her doctor felt that a repeat surgery would be necessary. Prior to surgery, our client underwent conservative care and also tried injections in an effort to alleviate the pain. Unfortunately, these measures failed. Ultimately, she underwent an extensive lower back fusion operation.

The defendant had a $50,000.00 bodily injury policy. We demanded that they pay their limits before our client’s surgery took place, which they agreed to do. Our client also had uninsured motorist coverage through her own insurance company in the amount of $200,000.00. After we provided a comprehensive demand package, the company offered only a small amount to settle the case. We steadfastly insisted that they pay the policy limits to our client. They continued to refuse, so our firm filed a civil remedy notice accusing the company of bad faith settlement practices. It was not until after a lawsuit was filed that the company finally decided to policy limit, and the case settled for a total of $250,000.00.
