$250,000 Car Accident Settlement in Port Charlotte, FL

In this case, our client was headed north on River Road in Port Charlotte, FL in the right lane. The defendant was also headed north on River Road in the left lane when he improperly attempted to merge into the right lane colliding with our client. Due to his negligence, the defendant was cited for careless driving.

Our client, who was a veteran, presented to the Bay Pines V.A. Hospital following the accident with a primary complaint of lower back pain. A CT scan taken shortly after the accident showed that he had suffered compression fractures to his fourth and fifth lumbar vertebrae. After conservative treatment failed and improve his pain, our client underwent two operations, known as kyphoplasties, to repair the broken vertebrae in his back.

Tragically, approximately two months after his final surgery, our client passed away from causes unrelated to his car accident. This, unfortunately, limited the damages we could bring a claim for to our client’s medical expenses plus the amount of his pain and suffering from the date of the accident until his death seven months later.

The insurance company for the defendant took the position that our client’s estate was entitled to very little since the accident did not cause our client’s death. We countered that severity of the injuries and the resulting suffering our client endured prior to his passing warranted a significant amount of compensation. Ultimately, we were able to convince the company to pay $250,000.00 to settle the claim.
