$951,268 T-Bone Collision Car Accident in Sarasota, FL

In this unfortunate Sarasota, FL car accident, the defendant was in the median waiting to make a left turn from U.S. 41 onto Prospect Street. As the defendant began his turn, he failed to notice a vehicle headed south in the left lane of U.S. 41 and caused a T-bone collision with that vehicle. As a result of the crash, the vehicle hit by the defendant continued across the median of U.S. 41 into the inside northbound lane where it collided with our client’s vehicle. The defendant was charged with careless driving in causing the accident.

Our client was taken by ambulance to Sarasota Memorial Hospital where it was quickly determined that she had suffered several fractures to her foot and ankle as well as a brain hemorrhage with a concussion. She was admitted to the hospital for several days for her injuries. Following her discharge, our client sought follow-up care with an orthopedic surgeon, a pain management physician, and a neurologist. Her neurologist diagnosed her with cognitive impairment, post-traumatic headaches, and post-traumatic stress disorder. In addition, her foot and ankle continued to cause her excruciating pain leading her neurologist and pain management doctor to conclude that she suffered from a condition known as Complex Regional Pain Syndrome (CRPS). This is a neurological condition characterized by extreme pain and disability.

Her doctors tried different injections in an effort to treat the CRPS. Nothing worked, however. Finally, her pain management physician implanted a device known as a spinal cord stimulator. This stimulator, which send low levels of electricity directly into the spinal cord in order to reduce pain, ultimately provided our client relief from her symptoms.

The defendant in the case had a one-million-dollar insurance policy, a small amount of which had been used to pay other claims arising from the accident. We believed that the case was worth the entire remaining amount and provided the defendant’s insurance company with a very detailed demand package which laid out everything our client had been through. Although they were resistant at first, we were able to convince the company to pay our client over $940,000.00.

We did not stop there. There was some evidence that the vehicle the defendant first struck had been speeding at the time of the accident. We contended that the driver negligently lost control of the vehicle causing him to go across the median and strike our client. His insurance company denied all liability contending that the sole blame rested with the defendant. We filed a lawsuit against the driver and initiated discovery. After nearly a year of hard-fought litigation, we prevailed on the driver’s insurance company to pay an additional $60,000.00 to our injured client. Our client was very happy with the result, and we were pleased that we were able to obtain much-needed compensation for her.

Getting Your Sarasota County Accident Report
