$1,600,000 Car Accident Settlement

Our client was a back seat passenger in a vehicle when the driver made an illegal left-hand turn violating the right of way of an approaching vehicle traveling in the opposite direction. This resulted in a head on collision.

Our client was rushed to the emergency room via helicopter and treated for a broken pelvis, broken leg, neck fracture, neck pain and a closed head injury with a brain bleed. The client had surgeries to repair the broken pelvis and leg injuries and conservative treatment and rehabilitation to recover from the injury to the brain.

A demand was presented to the defendant’s insurance company. The initial offer was only $300,000. That offer was rejected.

Suit was filed immediately after receiving such a low offer. Depositions of the defendant driver, witnesses, and our client’s treating doctors were taken. Our client submitted to examinations by physicians hired by the defendant’s insurance company. One of these physicians confirmed our client had a closed head injury that was permanent.

We represented a 31-year-old client in this car crash case. Our client was traveling south on Broad Street in Brooksville, FL approaching the intersection with Whitman Road. The defendant, traveling the opposite direction on Broad St. failed to see our client and attempted to turn left onto Whitman Rd. directly in front of our client causing a serious crash.

Our client was transported to the hospital with head, neck, and back pain immediately after the accident. There he was examined and underwent CT scans and was told to seek follow-up treatment. Our client began treatment with a sport medicine physician, who initially recommended MRI scans for the neck and back. These scans revealed herniated spinal discs in both the neck and lower back. Our client was thereafter referred to an orthopedic surgeon who performed nerve blocks and epidural steroid injections to help relieve the pain.

In March of 2023, the Florida Legislature passed a tort reform bill that disadvantaged injured people in numerous ways. The new law applied to any case filed in court after it was passed. Therefore, we proactively filed a complaint on behalf of our client in circuit court before the new law took effect so that the previous law would apply to his case. The defendant’s insurance company hired an attorney, and we agree to hold off serving the complaint on the defendant while we attempted to negotiate a settlement for our client. Initially, the defense offered only $75,000.00. We pushed them hard to negotiate in good faith letting them know that we were ready and willing to litigate the case for our client if they were unwilling to make a fair offer. Ultimately, we were able to convince them to more than double their offer, and the case settled for $165,000.00. Our client was thrilled with the result in the case.
